Gabriel Soto will receive almost 2 million pesos after winning a lawsuit for moral damage

After Gabriel Soto took legal action in 2016 against a famous magazine that shared photos of him with theto actress Marjorie de Sousa where it was rumored that both had a relationshipthe soap opera heartthrob will finally receive the money earned from the lawsuit.

According to an interview shared by TV and novels, Lawyer Gustavo Herrera, Soto’s representative, reported the sentence of the first trial.

“You have to keep in mind that there are two lawsuits against that magazine: the first started almost six years ago and there are six issues that are being claimed. This first demand was the one that, in August of last year, generated a jurisprudence of the Supreme Court by Gabriel Soto; there the right to privacy was resolved and it is established that the privacy of public figures must be respected, ”he reads.

In this sense, the litigant deepened that the Federal Copyright Law sanctions with 40% from the sale of each issue of the magazine.

“Demand has two very important benefits: en the first place is the non-pecuniary damage and from that damage comes the consistent material damage in the illegal use of the person for profit or commercial purposes,” said Herrera.

Also, the amount that TVNotes, half defendant, must pay the actor would be 1 million 800 thousand pesos for the concept of moral damage and the amount must be paid within a term of five days counted from the date the judgment is legally enforceable.

However, Herrera pointed out the possibility that the magazine would choose to introduce an injunction after the judge’s final decision.

“They probably want to prolong his death and introduce an injunction against this sentence that resolved the non-pecuniary damage to be paid. If they want to do it, let them do it, but they are going to be denied and then yes, once that point is resolved“, said.

And it is that in 2016, when these images were released, Gabriel Soto was married to Geraldine Bazan. At that time, the actor came out to deny the facts and in November 2021 he won the lawsuit against the Notmusa editorial magazine for the illegal use of his image.

As a public figure you do not stop being an example depending on what you do, good or bad for people. My objective has always been justice, when something is not fair to me, I fight to the last consequences and from the demands that I have made we have set important precedents”, explained Soto for Eph in a recent interview.

But this is not the first lawsuit that Gabriel Soto wins, since he also took legal action with his current partner Irina Vaeva against Laura Bozzo, after she made comments about Baeva’s guilt in the actor’s separation from his ex-wife.

But as if this were not enough, in 2020 Soto was the victim of the leak of an intimate video on social networks, which caused emotional impact and family problems.

This led him to exercise the corresponding complaint promoted by the recently approved Olympia Law in Mexico that punishes as a crime the disclosure, publication, sharing and distribution of images, videos or audio of sexual content of an adult person without their consent.

“It’s not easy, it takes a lot of time, energy and a lot of money, but the damage they did to me was a lot and that’s why it’s worth continuing to fight,” the actor said recently.
